Support for injured workers and next of kin

Suffering a serious injury at work or having a loved one die as a result of a workplace incident can be an extremely difficult period in life.
The following information is to help support you during this difficult period.

Support is available from the following counselling services if you are experiencing emotional distress.

Financial assistance

Injured workers and families and dependants of someone who has died at work maybe eligible for financial assistance under the Return to Work Act 1986.

  • If you have been injured at work, complete the workers compensation claim form and lodge it with your employer. Additional information on the workers’ compensation is available on our website or by calling our Workers Rehabilitation and Compensation Team on 1800 250 713.

  • Financial assistance to help with funeral expenses maybe available for someone who has died at work.

    In addition, the spouse and dependants (such as children) of someone who has died at work may also be eligible for other financial assistance in addition to the funeral expenses.

Which organisations are involved after a serious incident or death?

A number of government and non-government organisations will become involved if you have either been seriously injured at work, or have had a family member die at work. The following list explains the role each organisation plays.

  • Northern Territory Police attend the majority of serious workplace incidents as the first responders. If the incident involves a motor vehicle, they will investigate to determine if breaches of the NT road rules have occurred.

    If the incident involving a death in the workplace, Northern Territory Police will prepare a report for the coroner, and will undertake the next of kin notification on behalf of the coroner.

  • The coroner’s office investigates deaths and suspected deaths in the Northern Territory on behalf of the community. The coroner’s office determines the cause of death, which may involve an autopsy and/or deciding to hold a public inquest.

    The coroner’s office is the central point of contact for bereaved families for all deaths defined as reportable. The coroner’s office employs a grief counsellor who can provide support or contacts to support services.

  • NT WorkSafe is responsible for enforcing the work health and safety (WHS) laws and will commence an enquiry into serious incidents or deaths in the workplace.

    NT WorkSafe will initially ensure that the workplace is compliant with the WHS laws, and will commence an investigation if it is suspected the serious incident or death was caused because the WHS laws were broken.

  • If you are injured at work, your employer should provide you with a form to make a workers’ compensation claim. Once you have completed the form, your employer is required to lodge the form with their insurer.

    If a death has happened in the workplace, the employer should be contacting their insurers about the incident and assist the family or next-of-kin to claim any eligible financial assistance.

  • The employer’s insurer will contact you once they have received your claim for either workers' compensation or financial assistance in the case of a death in the workplace.

NT WorkSafe Support Officer

NT WorkSafe investigations and any subsequent prosecutions can be quite complex. It may take up to two years until a prosecution is finalised in court.

NT WorkSafe understands the importance of keeping injured workers and families updated and involved in the investigation and prosecution process whilst maintaining the integrity of the investigation.

When an investigation commences, a NT WorkSafe Support Officer is assigned as the point of contact for injured workers and family.

The NT WorkSafe Support Officer will:

  • Provide regular updates on the progress of the investigation.
  • Provide updates on the outcome of the investigation, including updates for any court proceedings.

Freedom of information

NT WorkSafe may limit the information provided to you about an investigation or case before the courts. The decision to limit information is to prevent prejudicing the investigation or evidence contamination which could harm the success of a prosecution.
