The Northern Territory workers' compensation laws consist of the Return to Work Act 1986 and the Return to Work Regulations.
The laws establish a rehabilitation and compensation scheme for the Northern Territory that provides:
- effective rehabilitation and compensation for workers
- a prompt and effective management of workplace injuries that promotes and assists workers to return to work
- a balanced scheme that provides adequate and just compensation to workers, while maintaining costs to a reasonable level for employers
The Northern Territory Workers' Compensation Scheme is a no fault scheme. There is no ability for a worker to sue their employer or co-worker of the same employer for negligence under common law (s52).
